Would a marine protected area help secure this fragile ecosystem or is it too late?<\/p>\n\n\n\n<p>When the&nbsp;<a href=\"https:\/\/www.theguardian.com\/world\/arctic\">Arctic<\/a>&nbsp;explorer Pen Hadow had to start swimming from ice floe to ice floe, rather than walking, he experienced for himself what scientists and Indigenous peoples of the north have long known: the floating sea ice, which used to reliably cover the Arctic Ocean for most of the year, is disappearing.<\/p>\n\n\n\n<p>For Hadow \u2013 who has crisscrossed that ocean on skis, both accompanied and solo \u2013 the vanishing ice wasn\u2019t just something that made his travels difficult. He knew that the Arctic ice is home to whole ecosystems above and below the water, protecting marine life from the worst impacts of humanity, pollution and the climate crisis. \u201cThe sea ice created a natural barrier,\u201d says Hadow. \u201cIt\u2019s undisturbed by vessels to this point.\u201d<\/p>\n\n\n\n<p>But for how long? The minimum extent of the ice in summer is dropping by&nbsp;<a href=\"https:\/\/climate.nasa.gov\/vital-signs\/arctic-sea-ice\/\">about an eighth<\/a>&nbsp;every decade. In June, scientists reported it is already<a href=\"https:\/\/www.theguardian.com\/environment\/2023\/jun\/06\/too-late-now-to-save-arctic-summer-ice-climate-scientists-find\">&nbsp;too late to save the summer ice<\/a>, foreshadowing a completely open Arctic Ocean for the first time since humans made the first stone tools&nbsp;<a href=\"https:\/\/www.nature.com\/articles\/ncomms6608\">2.6m years ago<\/a>.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\" id=\"79b338ef-0527-407e-b3c9-0b4bd781fd59\"><img decoding=\"async\" src=\"https:\/\/i.guim.co.uk\/img\/media\/7d04ed7e8ebf5a68db9a4d7172428553700c3e40\/0_0_2000_1335\/master\/2000.jpg?width=445&amp;dpr=1&amp;s=none\" alt=\"Man lies on edge of ice and lowers scientific equipment into water\"\/><figcaption class=\"wp-element-caption\">A scientist on an expedition led by Pen Hadow looks for evidence of plastic pollution among Arctic ice floes.&nbsp;Photograph: Conor McDonnell<\/figcaption><\/figure><\/div>\n\n\n<p>As it melts, it invites in ships \u2013 offering them the chance to shave thousands of miles off common routes, to exploit the ocean\u2019s largely untouched fish populations and dig up minerals on the seabed.<\/p>\n\n\n\n<p>Without the ice as a natural barrier, the central Arctic Ocean \u2013 an amoeba-shaped area of water spanning more than 1m sq miles (2.8m sq km) off the coasts of Canada, Russia, Greenland, Norway and the US \u2013 is open territory. International waters are beyond any country\u2019s jurisdiction. However, a patchwork of recent treaties \u2013 including a\u00a0<a href=\"https:\/\/www.un.org\/bbnj\/\">UN treaty on the high seas<\/a>, agreed on 19 June \u2013 is providing new means of protecting the water column from chemicals, noise and traffic; the seabed from fossil fuel exploration and\u00a0<a href=\"https:\/\/www.theguardian.com\/environment\/2023\/jul\/08\/future-of-deep-sea-mining-hangs-in-balance-as-opposition-grows\">mining<\/a>; and fisheries from overexploitation.<\/p>\n\n\n\n<p>Nevertheless, without international cooperation, that potential will be wasted. Hadow, through his&nbsp;<a href=\"https:\/\/www.90northfoundation.org\/\">90 North Foundation<\/a>, is among those fostering that cooperation with the aim of trying to designate the entire middle of the Arctic Ocean a marine protected area (MPA).<\/p>\n\n\n\n<p>The effort was part of what won him the 2023 Shackleton Medal for the Protection of the Polar Regions, an award inaugurated the year before. Hadow wants no fishing, no shipping, no mining, and no oil and gas in the Arctic ocean at all. \u201cThis is a rest-of-life mission for me,\u201d he says.<\/p>\n\n\n\n<p>Without an MPA, he adds, the central Arctic Ocean is in danger of becoming an unprecedented free-for-all.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>T<\/strong>he ocean is a multidimensional space: the air above, the surface, the water itself, the seafloor and the area beneath that. In the Arctic, the surface is a floating pan of ice, home to seals, polar bears, birds, foxes and other animals that depend on its hard crust to travel, hunt and rest. Beneath the surface, more animals depend on the underside of the ice: bowhead whales use it to shield themselves from orcas, while Arctic cod feed on the algae that grow on it.<\/p>\n\n\n\n<p>Not only does this delicate ecosystem need the ice, but if it vanishes it could simultaneously enable another set of harms \u2013 when the world\u2019s fishing fleets arrive. Commercial ships are already depleting fish populations all over the world; without an understanding of the Arctic Ocean\u2019s capacity to handle industrial fishing, they will be at risk of doing the same here.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\" id=\"96fc86af-140a-4a65-b1a0-4d6710011af4\"><img decoding=\"async\" src=\"https:\/\/i.guim.co.uk\/img\/media\/b426ddcdf9c8a18a1bc95b67bb6bfbbbff3fdfa5\/0_0_4000_2665\/master\/4000.jpg?width=465&amp;dpr=1&amp;s=none\" alt=\"Icebergs in the sea at sunrise, with backdrop of mountains\"\/><figcaption class=\"wp-element-caption\">Icebergs off the coast of Kulusuk Island, Greenland. Vanishing sea ice is opening up previously untouched Arctic waters to fishing fleets.&nbsp;Photograph: Felipe Dana\/AP<\/figcaption><\/figure><\/div>\n\n\n<p>In October 2018, the world came together to address this threat by&nbsp;<a href=\"https:\/\/www.theguardian.com\/environment\/2018\/oct\/03\/commercial-fishing-banned-across-much-of-the-arctic\">banning commercial fishing<\/a>&nbsp;in the central Arctic Ocean. It was a strong endorsement of the precautionary principle, guarding an understudied ocean against the potential for unknown levels of exploitation.<\/p>\n\n\n\n<p>\u201cIt was an incredible achievement,\u201d says Martin Sommerkorn, head of conservation for the WWF Arctic Programme. Critically, the agreement included not only the main Arctic states \u2013 Canada, Russia, Denmark, Norway, the US and Iceland \u2013 but also China, Japan, South Korea and the EU, all of which have large \u201cdistance\u201d fishing fleets that could push to enter new Arctic waters.<\/p>\n\n\n\n<p>The agreement is worded in such a way that suggests commercial fishing will eventually take place in the Arctic, but not before it is better understood. To that end, the 90 North Foundation says it will spend \u00a3125m-\u00a3150m on research over the next 15 years to help persuade world leaders that protection is necessary.<\/p>\n\n\n\n<p>\u201cTo say, \u2018Let\u2019s not bother [protecting the Arctic Ocean] because we don\u2019t know\u2019 is not the right way of looking at it, in my view,\u201d says Hadow.<\/p>\n\n\n\n<p>The UN treaty on the high seas, signed in June, succeeded the fishing treaty, as an even more useful legal tool for protecting international waters. To date,&nbsp;<a href=\"https:\/\/www.arcticwwf.org\/newsroom\/reports\/a-guide-to-arcnet-an-arctic-ocean-network-of-priority-areas-for-conservation\/\">all of the Arctic\u2019s protected marine regions<\/a>&nbsp;have been inside the 200-mile exclusive economic zones (EEZs) of individual countries. The largest such protected area, designated in 2019, is Canada\u2019s Tuvaijuittuq MPA, known as the Last Ice Area because it is expected to be the last Arctic place to have sea ice after the rest has melted.<br><br>Despite the recent victory, some observers argue that it is better for countries to focus on areas inside their own territory, such as Tuvaijuittuq. Michael Byers, an international law scholar and Arctic expert, believes countries can more successfully protect their own ocean networks, particularly in rich coastal waters.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\" id=\"11d6f87d-4002-451b-a3ef-e7db42fa2d0f\"><img decoding=\"async\" src=\"https:\/\/i.guim.co.uk\/img\/media\/58026fad3bbc4f653083a2b861aaac6c59a1d74f\/0_0_5616_3694\/master\/5616.jpg?width=445&amp;dpr=1&amp;s=none\" alt=\"Whale rises out of water head-first; shoreline and ice floe in background\"\/><figcaption class=\"wp-element-caption\">A bowhead whale breaching off Igloolik Island, Canada. He argues the alternative would be difficult to agree on and provide less protection.<\/p>\n\n\n\n<p>Lisa Koperqualuk, president of the Inuit Circumpolar Council of Canada, agrees. She wants Inuit in her country to co-manage a Pikialasorsuaq protected area with Inuit in Greenland \u2013 a rare instance of cross-border protection by Indigenous peoples.<\/p>\n\n\n\n<p>\u201cBecause of our knowledge and our relationship with the marine area, that ties in with our right to self-determination and our right to take part in decisions relating to the Arctic waters,\u201d Koperqualuk says.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\" id=\"a0841074-f3ee-42e6-a7c5-48caf80ae00a\"><img decoding=\"async\" src=\"https:\/\/i.guim.co.uk\/img\/media\/34323991ca5bd27cb9d22e97cbc51f1baa651604\/0_0_7488_5793\/master\/7488.jpg?width=465&amp;dpr=1&amp;s=none\" alt=\"Man pulls loaded sledge across ice. The new high seas treaty still has to be ratified by the individual states, but it is no longer wishful thinking to imagine prohibiting activities such as oil and gas extraction, mining, bottom-contact trawling and dumping in international waters.<\/p>\n\n\n\n<p>Ant\u00f3nio Guterres, the UN secretary general,&nbsp;<a href=\"https:\/\/twitter.com\/antonioguterres\/status\/1670923937524350976\">tweeted<\/a>&nbsp;recently: \u201cThis historic achievement is an example of global threats being met by global action.\u201d<\/p>\n\n\n\n<p>Threats remain to the Arctic, however, including seabed mining, which many conservationists and scientists warn could&nbsp;<a href=\"https:\/\/www.theguardian.com\/environment\/2023\/mar\/26\/deep-sea-mining-for-rare-metals-will-destroy-ecosystems-say-scientists\">destroy ecosystems<\/a>&nbsp;by stripping the ocean floor and kicking up clouds of sediment, although others say it is needed for the&nbsp;<a href=\"https:\/\/www.reuters.com\/sustainability\/climate-energy\/norway-moves-open-its-waters-deep-sea-mining-2023-06-20\/\">green energy transition<\/a>. Norway has announced plans to mine in an area of the Arctic Ocean identified as a&nbsp;<a href=\"https:\/\/www.arcticwwf.org\/our-priorities\/nature\/arcnet\/\">high priority for conservation<\/a>&nbsp;by the WWF; only a full international Arctic MPA could prevent it.<\/p>\n\n\n\n<p>Then there is shipping, which brings noise, pollution, invasive species and ship strikes. At its most recent meeting, the International Maritime Organization (IMO) tightened the polar code governing ship travel. But a&nbsp;<a href=\"https:\/\/pame.is\/images\/03_Projects\/MPA\/MPA_Report.pdf\">report from the Arctic Council<\/a>&nbsp;called on it to go further and declare the entire Arctic Ocean a particularly sensitive sea area (PSSA), thereby restricting traffic.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\" id=\"6cd6c26e-d546-4309-b578-8acdace999b4\"><img decoding=\"async\" src=\"https:\/\/i.guim.co.uk\/img\/media\/fbb7ee0a6a5d34f878af4a4cb0ddcae610d1fd5d\/0_0_2000_1252\/master\/2000.jpg?width=445&amp;dpr=1&amp;s=none\" alt=\"Aerial view of ice floes and two yachts\"\/><figcaption class=\"wp-element-caption\">Pen Hadow\u2019s expedition research vessels are<em>&nbsp;<\/em>temporarily moored to an ice floe in the central Arctic Ocean in the summer of 2017.&nbsp;Photograph: 90 North Foundation<\/figcaption><\/figure><\/div>\n\n\n<p>To make matters worse, the Arctic Council is not meeting due to the war in Ukraine. The council, established after the cold war as a forum for science, development and conservation, has long been praised for avoiding the tensions that can work their way into international organisations. But Russia\u2019s invasion of its neighbour has halted much Arctic protection work.<\/p>\n\n\n\n<p>Byers calls Russia \u2013 which has laid claim to swaths of Arctic seafloor including the area&nbsp;<a href=\"https:\/\/polarjournal.ch\/en\/2023\/02\/21\/russias-claim-to-north-pole-territory-officially-confirmed\/\">under the north pole itself<\/a>&nbsp;\u2013 \u201can indispensable partner in the central Arctic Ocean\u201d. Even if council meetings did resume, he doubts serious protections would happen if Russia were not there. \u201cAn Arctic Ocean MPA without Russia would be like a Lake Ontario MPA without Canada,\u201d Byers says.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>T<\/strong>aken together, the various individual measures and agencies could theoretically cover many of the direct threats to the Arctic Ocean and do away with the need for an all-encompassing MPA. But patchwork protection has downsides. Different treaties, negotiated separately, are weaker than a single umbrella treaty \u2013 particularly when it comes to anticipating and responding to new threats. There are \u201cexternal\u201d threats, too, such as&nbsp;<a href=\"https:\/\/www.theguardian.com\/environment\/2022\/sep\/29\/arctic-ocean-acidifying-up-to-four-times-as-fast-as-other-oceans-study-finds\">acidification due to global heating<\/a>, or the accumulation of pollutants that migrate into Arctic waters via the \u201c<a href=\"https:\/\/www.unep.org\/news-and-stories\/story\/grasshopper-effect-serves-pollutants-plates-arctic-peoples\">grasshopper effect<\/a>\u201d.<\/p>\n\n\n\n<p>Sommerkorn says: \u201c[A patchwork] might be OK, as long as you have static conditions. Ice-free summers by mid-century are very likely; without the ice to reflect heat, the ocean will warm even faster, potentially affecting&nbsp;<a href=\"https:\/\/climate.esa.int\/en\/projects\/sea-ice\/news-and-events\/news\/simulations-suggest-ice-free-arctic-summers-2050\/\">global ocean circulation<\/a>. Most of the damage already being wreaked in the Arctic is indirect, via the warming and acidification of the oceans from the continued burning of fossil fuels. Protecting an area by drawing a line around it can only go so far.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\" id=\"d75c1399-a751-4ba1-ad60-d8c25122834c\"><a href=\"https:\/\/www.theguardian.com\/environment\/2023\/jul\/24\/russia-barents-sea-toxic-legacy-military-buildup-mining-shipping-indigenous\"><img decoding=\"async\" src=\"https:\/\/i.guim.co.uk\/img\/media\/0a80003fb5a6b0de4fc98f6362bb466fa9fc9d24\/260_0_3727_2237\/master\/3727.jpg?width=460&amp;quality=85&amp;auto=format&amp;fit=max&amp;s=5291cedb408b944e0454c7775ae24325\" alt=\"Submarine powering along surface of water\"\/><\/a><\/figure><\/div>\n\n\n<p>\u201cIt\u2019s an interesting nut that hasn\u2019t been cracked,\u201d Sommerkorn says. \u201cHow do you motivate the protection of a place \u2026 not through direct measures, but through mitigation elsewhere?\u201d<\/p>\n\n\n\n<p>Sommerkorn wants to see more MPAs established across the Arctic \u2013 within national boundaries and between nations \u2013 but he notes that protected areas are about more than an individual patch of land or sea; they provide havens for species to thrive while the environment outside is in decline.
